Annexation Request Tabled With 3-Month Deadline

At the February Midvale City Council meeting, a hearing was held concerning a request by Jesse Whitener to annex 66 acres on Bonner Road into the city. The council tabled the issue at that meeting to further investigate the matter.

At the March 11 meeting, city attorney Dan Chadwick advised that councilman Brady Whitener be excused from the meeting because of possible conflict of interest. After Brady left the meeting, the council discussed the annexation request. Mayor Brian Graham reported that no development plans for the parcel had been submitted by meeting time. As part of the meeting record, Councilman Charles Downey read a three-page statement regarding his research of the city code and how it applies to the annexation request.

The submitted statement included city code references to protecting property rights and property values of current city residents, adequate public facilities and services at reasonable cost to current city residents, protect and enhance the economy of current and future city residents, and protect prime agricultural lands for production of food, fiber and minerals. The statement reads: “I believe, based on Midvale City Code and my experience in land use issues that this application for annexation may not be in the best interest of the City and its current residents, or the surrounding population at this time.” Also mentioned was the possibility of the city needing to upgrade water services or provide sewer services, which would “constitute a financial catastrophe to the City and its residents.” The possibility of Washington County Road & Bridge turning over those roadways to the City would also constitute a hardship.

The council approved a motion to table the annexation request with a limit of three months, a deadline of June 10.

Also approved at the meeting was a request by Dixie Winther to use the city park May 22-27 for a swap meet. The clerk will give her the list of restrictions regarding camping, etc.

A request to paint the crosswalk across HWY 95 will be given to ITD. Also to be suggested to them will be a crosswalk light for HWY 95.

The next regular meeting will be April 8 at 7:00 p.m..
